This Privacy Notice (“Notice”) sets out how Ethical Bean Coffee uses and protects the information we collect from and about you when you visit any of our websites where this notice is posted (or the mobile optimized version of the website), when you use the Ethical Bean mobile application (each a “Site”), or when you otherwise interact with us online or in person. Ethical Bean Coffee is committed to ensuring that your privacy is protected and that personal information we collect from you will only be used in accordance with this Privacy Notice. Ethical Bean Coffee may change this Notice from time to time by updating this page.

Please note that this Notice applies only to personal information collected through the Site and does not cover personal information collected through other apps or websites. For example, the Site includes links to our online store, which is a third-party website hosted by Shopify Inc. in Canada and Amazon Inc. in the United States. They provide us with the online e-commerce platforms that allow us to sell our products and services to you. Personal information you provide in connection with use of our online store is collected by Shopify for Canadian customers and Amazon for United States customers. WHAT INFORMATION DO WE COLLECT?

When registering for an account on the Site, you may be asked for your name and contact information and to create a password. When ordering through the Shopify online store, you may be asked to enter your name, email address, shipping and billing addresses, phone number, credit card information or other details including information relevant to customer surveys and/or offers to help you with your experience.

Information about your device — including your device type, advertising ID, time zone, and some of the cookies that are installed on your device — may be automatically collected when you use the Site. Additionally, as you browse our online store, we collect information about the products you view and how you navigate around the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit this website.
  • “Log files” track actions occurring on the Site and collect data including your device ID, browser type, mobile service provider, device type, and operating system.

WHEN DO WE COLLECT INFORMATION?

We collect information from you when you visit the Site, download and use the Ethical Bean Mobile Application, register a customer account, place an order, locate a store, or otherwise enter information on the Site.

HOW DO WE USE YOUR INFORMATION?

We may use the information we collect from you when you browse the Site, register, make a purchase, subscribe to our newsletter, respond to a survey or marketing communication, or use other Site features in the following ways: to personalize user experience and allow us to deliver the type of content and product offerings in which you are most interested, to quickly process your transactions, and to communicate with you about your order status. We use Device information to improve, adjust, and protect the Ethical Bean Mobile Application, its content, our services, and our networks.

We also send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided. From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, or mail, depending on your contact preferences and the personal information you have provided.

We may use the information we collect from and about you for various purposes, including providing you with the products and services you have requested, improving our Site, products, and services, developing new products or services, communicating with you as necessary, providing you with personalized content and offers, protecting the security or integrity of the Site and our business, using your data in an aggregated non-specific format for analytical and demographic purposes, and as otherwise described to you at the point of data collection.

Additionally, if you use the Site to connect with third-party services you authorize us to use information from and about you, on your behalf, to interact with these third-party services based on your requests.

We may use your identity, contact, technical, usage, account, and profile data, including identity, contact and profile data we have received from data brokers or aggregators, to form a view on what we think you may want or need, or what kinds of products and services may be of interest to you. Combining data from multiple sources in this way is commonly known as “enriching data” or “profile building”. This is how we decide which products, services and offers to include in marketing messages we send. This process may involve automated decision-making to determine which marketing messages will be most meaningful to you based on your interests, preferences, and location. There may also be other instances where we may use your personal information to render a decision based on automated processing of such personal information. We will not use Special Category Data or Sensitive Personal Data in building a profile about you unless you give us your consent to do so.

HOW DO WE SHARE YOUR PERSONAL INFORMATION?

We do not sell or otherwise disclose personal information about our Site users, except as described here. We do not share your personal information with unaffiliated third parties for their own marketing purposes without your consent. We may share the information we collect from and about you in the following ways: (1) among our affiliates, parent company, and subsidiaries; (2) with our third party service providers we have retained to perform a business, professional or technical support functions for us, including to the extent necessary or desirable to help run promotions, fulfill orders, complete transactions, or provide customer service (these service providers may have access to personal information about our Site users if it is needed to perform their functions for us, but they are not authorized to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements); (3) as necessary to investigate or prevent an actual or suspected crime or injury to ourselves or others, as permitted by law; (4) if we believe that there has been a violation of our Terms of Use or of our rights or the rights of any third party; (5) to respond to judicial process or provide information to law enforcement authorities, regulatory agencies, or other government officials, or otherwise as required by law; and (6) as otherwise described to you in this Notice and at the point of collection.

During the normal course of our business, we may sell or purchase assets. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity in connection with the transaction. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use personal information provided through the Site in a manner that is consistent with this Notice.

We do occasionally provide a list of email addresses to advertising partners in order to reach our customers, these email addresses are used so that those partners can help us reach you with promotional offers, they are not provided to third parties for their own use. We encourage you to review the Privacy Policies of platforms that offer these services such as Facebook, Instagram, Twitter and other social networks. These sites have separate and independent privacy policies and we are not responsible or liable for the content and activities of these sites.

Data processing within our group of companies (including our parent company) may be done via servers located outside of Quebec, Canada, and the United States. Some of our supplier, advertising, or promotional agency service providers as described above may also be located outside of Quebec, Canada, and the United States. As a result, your personal information may be accessible to regulatory authorities in accordance with the laws of other jurisdictions. DO WE USE “COOKIES” OR OTHER TRACKERS?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the Site or service provider’s systems to recognize your device or browser and capture and remember certain information.

Cookies allow applications to respond to you as an individual. The application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences. For instance, we use cookies to help us remember and process the items in your shopping cart. They may be also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. Certain parts of our Site require cookies. CHILDREN’S PRIVACY

We do not knowingly collect, maintain or use personal information from children under 13 years of age, and no part of the service is directed to children under the age of 13. If you learn that your child has provided us with personal information without your consent, you may alert us at the contact information listed below. If we learn that we have collected personal information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.

HOW DO WE PROTECT AND RETAIN YOUR INFORMATION?

We highly value our customers’ privacy and work hard to protect and secure your information. Although no method of transmission over the Internet or electronic storage is 100% secure, we take steps to ensure that our security, and the security of our partners and service providers, meets or exceeds generally accepted industry standards. The security of your information is important to us. We have taken certain administrative, technical, and physical steps to safeguard the information we collect from and about our customers and Site visitors against unauthorized use, disclosure, alteration, or destruction. While we make every effort to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures.

Personal information is maintained on our servers or those of our service providers and is accessible to authorized employees, representatives and agents who require access for the purposes described in this notice. We retain personal information in accordance with our record retention policies. Retention periods are set taking into account the purpose for which the personal information was collected, applicable legal requirements, and our legitimate need to retain business records for reasonable periods.

When you place an order through the Shopify online store available through the Site, we will maintain your order information for our records for as long as we are allowed to under applicable law. Typically, we do not put a monetary value on your personal information.  However, California law requires we provide a valuation of personal information collected in connection with a financial incentive. The value of the personal information you provide while participating in a Program is based upon our reasonable and good-faith estimation of the value of such information, which considers, without limitation, the value and purpose of the Program, associated expenses, the type and usage of the collected personal information, and the number of individuals who participated in the Program.

Your Rights and Choices

You have the right to request that we provide certain information to you about how we collected and used your personal information. Specifically, you have the following rights:

Right to Access: You have the right to request access to categories and specific pieces of personal information about you that we collect, use, disclose, share, and sell. If requested, we will provide you a copy of your personal information we collected as permitted by CCPA.

Right to Delete: In certain circumstances, you have the right to request that we delete personal information that we collect from you, subject to applicable legal exceptions. Upon verifying the validity of a deletion request, we will delete your personal information from our records.

Right to Know: You have the right to know the information that we collect, as defined in the CCPA.

  • The categories of sources of personal information we collected about you;
  • The business or commercial purpose(s) for which we collected, sold, or shared your personal information; and

Right Not to Receive Discriminatory Treatment: You have the right not to receive discriminatory treatment for exercising your privacy rights described by the CCPA.

A verifiable consumer request must provide us adequate information to allow us to (1) reasonably verify that you are the individual whose personal information we collected (or an authorized representative) and (2) to understand your request so that we can process and respond to it. Please note that only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may submit a verifiable consumer request for your personal information.
